The SCDDA obliges companies to check their supply chain for possible violations of human rights, labour rights and environmental standards.
Transparent and responsible behaviour, ethical and sustainable principles must be demonstrated, otherwise fines may be imposed.
The company's own ability to deliver must be ensured. This requires a legally compliant ability to deliver on the part of direct suppliers from 1 January 2024 at the latest.

What is important?- Establshment of a risk management system (Sec. 4 (1))
- Definition of an internal company responsibility (Sec. 4 (3))
- Implementation of regular risk analyses (Sec. 5)
- Submission of a declaration of principles (Sec. 6 (2))
- Incorporation of prevention measures within the own business area (Sec. 6 (1) and (3)) and vis-à-vis direct suppliers (Sec. 6 (4))
- Taking remedial measures (Sec. 7 (1) to (3))
- Establishment of a complaints procedure (Sec. 8)
- Implementation of due diligence obligations with regard to risks at indirect suppliers (Sec. 9)Documentation (Sec. 10 (1)) and reporting (section 10 (2))
The law is based on the United Nations Guiding Principles on Business and Human Rights and the National Action Plan on Business and Human Rights of 2016 in the Federal Republic of Germany.
The law applies to companies in Germany with more than 3,000 staff from 2023 and to companies with more than 1,000 staff from 2024.
Non-compliance with this law is punished with fines and penalties.
